Uniform Domain Name Dispute Resolution Policy (UDRP)
As you are aware that Domain Name registrations is the first and most important aspect in uploading any web site. In simple terms, Domain Name is a simple, easy to remember names for computers on the Internet. This Domain Name is a unique internet address assigned to each computer to connect with remote Computer or a Server. It comprises groups of alphanumeric characters separated by dots.
In this world of Internet it is imperative to register not only generic Top Level Domain Names (gTLD) such as .com, .net or .org but country code Domain Names too such as .in, .uk., .au etc. As we know, domain names registration is not a difficult process and can be registered seating on any corner of the world. Domain Name registrations do not have to follow any specific procedure, examination, oppositions etc. like a trademark registration. Domain Name registration is on the spot process. Domain Name system is administered by a World Authority called “Internet Corporation for Assigned Names and Numbers’ – ICANN. Registration is done online by few authorised Registration Authorities like www.networksolutions.com, www.register.com, www.registry.in and many others as approved by ICANN.
Due to such easy registration process, unfortunately abuse of improper grabbing of some one else’s Domain Names / famous trademarks has become an universal phenomena and it is called as “Cybersquatting”. Cybersquatting also includes registering and uploading web sites giving or misrepresenting to the people as of the original goods/service providers.
To resolve such improper grabbing / misrepresentation, ICANN (has formulated an Uniform Dispute Resolution Policy (UDRP) whereby:
- Some of the organizations have been authorized to resolve the disputes through UDRP like WIPO, The national Arbitration Forum, eResolution and CPR Institute for Dispute Resolution.
